DATED : 4 th March, 2015 PER COURT : 1] This is an application for restoration of Criminal Writ Petition No. 897 of 2012 which was dismissed for nonremoval of office objections. 2] The original petitioner challenges the order of maintenance granted in favour of the original respondent.
3] Looking to the fact that the petition is dismissed only for nonremoval of office objections, therefore, a fresh opportunity is to be given to the
crap3911.13 petitioner to remove the office objections.
4] Hence, present Criminal Application for restoration of Criminal Writ Petition is allowed, subject to the payment of costs of Rs.5,000/ to the respondent. The costs shall be paid within a period of one week. If the amount of costs is deposited with the Registry within a period of one week from today, then only Criminal Writ Petition No. 897 of 2012 shall stand restored.
5] If amount of Rs.5,000/ is deposited by the applicant, the respondent will be at liberty to withdraw the said amount, which is deposited by way of costs.
