Heard the learned counsel for the applicant and the learned A.P.P. for the respondent State.

The applicant was seeking bail for his long incarceration from 2021. The progress report has been called from the learned trial Judge. It has been informed that one witness has been examined. However, due to absence of accused, the charge could not be framed. 3.

After having gone through the facts of the case, the Court expressed disinclination to grant bail, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application,

940 B.A. 1129-23-.odt adding prayer to direct the Sessions Court to expedite the trial within a fixed time.

The case is of the year 2021. The Court has no material how many old undertrial prisoners' cases are pending in the trial Court. The progress report is not in detail. However, the case against the applicant was opened and one witness was examined. So it may be possible to the trial Judge to conduct the trial making more endavour. Hence, the learned Special Judge is directed to make sincere efforts and keep the matter day to day for speedy disposal. 5.

In view of the above directions, the application stands dismissed as withdrawn.
