During the course of arguments, learned Counsel for the informant submitted that for the reason of collusion between police officers of Satara Police Station and accused, offence was not immediately registered. She also make grievance that NC recorded by son of the informant is also not recorded as per his say.

If this is found to be true, it is a matter of serious concern. Hence, Commissioner of Police,
Aurangabad is directed to conduct an inquiry into it and submit report to this Court.

The said report to be filed before this Court within a period of two weeks.

As far as applicant in ABA/1175/2023 is concerned, considering the fact that co-accused against whom similar role is attributed are protected by interim order, his liberty is protected till next date of hearing.

Hence, the order:
O R D E R
(i) Issue notice to the Respondents. Learned APP waives service of notice on behalf of Respondent Nos. 1 & 2.
(ii) Till next date, in the event of arrest the Applicant - Deepak Madhukar Shinde in ABA/1175/2023 in connection with C.R. No.
161 of 2023 registered with Satara Police Station, Dist. Aurangabad for the offences punishable under Sections 326, 323, 504, 506, 141, 143, 147 and 149 of IPC, he shall be released on bail on furnishing PR bond of Rs. 15,000 (Rupees Fifteen Thousand Only) with one solvent surety in the like amount.
(iii) He shall attend the concerned police station once in a week.
(iv) He shall not contact the witnesses
directly or indirectly.
(v) He shall not interfere with the evidence in any manner whatsoever.
(v) He is further directed to cooperate the investigating agency for further investigation.
6.
Stand over to 11th August, 2023. Interim relief to continue till next date of hearing.

All concerned shall act upon an authenticated copy of this order.
