The present applicant, who is arrested by Partur Police Station, Tq. Partur, Dist. Jalna in crime no. 122 of 2013 for the offence punishable under section 307, 353, 332, 333, 323 r/w. 34 of the Indian Penal Code, is praying for his release on bail.

The allegations against him would show that he has assaulted two Police Head Constables with knife when they went to arrest him. The injury certificate bear out these allegations.

The earlier application of the present applicant bearing Criminal Application No. 5800 of 2014 was allowed to be withdrawn by this Court vide order dated 26/11/2014, with liberty to file similar application after a period of six months.

The report of the concerned Sessions Court would show that the trial would be concluded within eight months.

Learned A.P.P. submits that in all 11 crimes are registered against the present applicant. He was absconding for eight months from the date of the incident and, thereafter, he was arrested.

Considering all the material on record, no case for releasing the applicant on bail, is made out. The application is therefore dismissed.

The learned Sessions Judge however is directed to expedite the hearing of the Sessions Case. [M.T. JOSHI] JUDGE arp/
