We have heard Mr. Murkute the learned counsel for the petitioner. Yesterday also we had asked the learned AGP to take instructions. It is the case of the petitioner that, by mistake the petitioner had filled in the form stating wrong reservation instead of applying from person with disability category, the petitioner wrongly mentioned reservation as hilly area. The case of the petitioner is that petitioner be allowed to compete. 2.

Learned AGP submits that petitioner is not eligible to seek admission to the M.B.B.S and B.D.S. course as the petitioner has not even secured 40% marks in MH-CET.

Rule 4.9 of the examination brochure in MH-CET lays down that for a person to be eligible for admission to the MBBS and BDS course, he should have secured not less than 40% marks in PCB. The petitioner has secured only 65 marks out of 200 i.e. not even 33% marks.
