Considering that, the application is by original claimant who lost his property in the acquisition proceedings and that the appeals are still pending, this Court is inclined to allow the application with some conditions. Hence, following order :

(I) Civil application is allowed.

(II) Delay of 3406 days caused in filing cross objection stands condoned.

(III) The applicant shall not be entitled to receive interest and benefits for the period of 3406 days caused in filing the cross objection.
