This is an application under section 438 of the Code of Criminal Procedure, 1973 preferred by the applicant seeking grant of pre-arrest bail in connection with Crime No.0371/2021, registered with Ambad Police Station, Taluka Ambad, District Jalna for the ofences punishable under Sections 498-A, 323, 504 and 506 of the Indian Penal Code, 1860.

It is the case of prosecution that the informant was married to applicant on 26.05.2019 and was treated well for
about one and half year. It is alleged that the informant's inlaws then started asking her to bring Rs. 2,00,000/-, so as to secure an employment for her husband and on this count applicant and in-laws without any reason abused and beat her. Ultimately, she was taken back by her father in the month of November, 2020.

Smt. S. P. Kakade, learned counsel for the applicant, submits that the applicant and his family members have been falsely implicated on account of domestic reasons. There is nothing to be recovered. The applicant being a respectable person in the society, would not fee from the justice, and therefore, application be allowed.

Mr. A. V. Deshmukh, learned APP for the Respondent - State, on the other hand, has opposed the submissions and submits that there being no merit in the application the same is liable to be rejected.

I have carefully gone through the contents of First Information Report. I found that the family members of the applicant including himself have been roped in on the allegation of cruelty. Needless to say and having regard to the nature of the alleged ofences, I do not fnd the necessity of
custodial interrogation of the applicant. This being so, I am inclined to allow the application.

In view of above, I pass the following order :
ORDER
(i) Application is allowed.
(ii) In the event of arrest of the applicant - Sanjay Ashok Jadhav herein in connection with Crime No. 0371 of 2021, registered with Ambad Police Station, Taluka Ambad, District Jalna for the ofences punishable under Sections 498-A, 323, 504 and 506 of the Indian Penal Code, 1860, the applicant is directed to be enlarged on bail on his furnishing P.R. Bond of Rs.20,000/- (Rupees Twenty Thousand only] with one surety in the like amount. (iii) Application is accordingly disposed of.
