The first appeal is dismissed against the owner of the vehicle in the year 2012. No steps are taken as against respondent No.1. The appeal is under the provisions of the Workmen's Compensation Act. As the appeal itself is dismissed against the owner, the matter cannot proceed. Even on earlier occasion, the counsel for the appellant was absent. However, the matter was adjourned to 19th August, 2015 for three weeks. Thereafter on 9th September for four weeks, thereafter on 7th October, for two weeks, however no steps are taken. The matter, in absence of Respondent No.1, cannot proceed only against respondent No.2 who is insurer of the vehicle of respondent No.1.

In light of above, the appeal stand dismissed. No costs.
