Learned counsel for the petitioner submits that, the validation proceeding is pending. The employer issued notice directing the petitioner to submit validity, else adverse action would be taken.

We have heard the learned A.G.P. for respondents. It appears that, the validation proceeding is pending since 2016. To get the validation proceedings decided within stipulated

period is not in the hands of the litigant. The vigilance is not conducted.

The impugned notice is quashed and set aside. The Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner expeditiously, preferably within a period of nine months from the date of appearance of the petitioner. Petitioner shall appear before the Committee on 1st December 2020 and co-operate in expeditious disposal of the proceedings.

Writ Petition is disposed of. No costs.
