Learned counsel for the applicant submits that the appeal preferred by the acquiring body came to be dismissed by this Court and therefore, the claimants are entitled to withdraw the compensation amount deposited by acquiring body before this Court. 2.

Learned counsel for the acquiring body has no objection if the claimants are permitted to withdraw the said amount, since the appeal is already dismissed by this court. In view of above, civil application is allowed in terms of prayer clause "B" and disposed of. ( V. K. JADHAV, J.) rlj/
