The learned counsel submits that pursuant to the judgment delivered by Civil Court in Regular Civil Suit No.388/2019 dated 16/6/1997 the petitioner had approached Tahsildar for correction of the mutation entry, however, the Tahsildar did not pass any order. The petitioner thereafter approached the Sub Divisional Officer and the Collector. They did not entertain the appeal on the ground that orders are not passed by Tahsildar. The Tahsildar/competent authority shall pass appropriate orders on the application filed by the petitioner for cancellation of mutation entry on its own merits in accordance with law after hearing all parties concerned. The decision shall be taken by the Tahsildar within a period of 4 months. 2] Writ Petition is disposed of. No costs.
