PER COURT:

1] Heard the learned counsel for the applicant and learned APP for respondent. In view of the reasons mentioned in the application, the delay of 28 days caused to file the application for restoration of revision petition stands condoned.

2] It has been submitted that inadvertently, the paper book was not prepared and on account of said failure, the Criminal Revision Application came to be dismissed by this Court. Learned counsel for the applicant submits that the paper book is ready and he undertakes to furnish the same to the Registry. Therefore, he prayed that the Criminal Revision Application No. 40 of 2017 be restored to its original stage. 3] Considering the submissions advanced on behalf of the applicant, I do not find any impediment to allow the application for restoration of revision application for substantial justice. Hence, the application stands allowed. The impugned order dated 9th February, 2017 passed by this Court is hereby quashed and set aside. The Criminal Revision Application No. 40 of 2017 is restored to its original position.
