The challenge in these appeals is on the ground of dishonour of cheque given towards premium of the policy of insurance. The quantum has also been challenged on the ground that the income tax returns relied upon by the claimants were submitted to the Income Tax Department post accident.

In this factual backdrop, the applicants are permitted to withdraw only 25% of the amount in deposit with this Court on furnishing usual undertaking to the satisfaction of the Registrar (Judicial) of this Court.
