The learned counsel Mr. Pawar submits that though there is a letter issued by the acquiring body for the readiness of settling the matters as per the decisions of Lok-Adalat dated 08/02/2023 in some of the matters, but the matters are to be heard on merits irrespective of direction of acquiring body to settle the matters considering the rate of 85% of the valuation of house structures. The letter dated 03/03/2023 issued by the acquiring body clearly indicates that the aforesaid rate must be followed and the concerned appeals be disposed of accordingly. 3.

As such, it appears that the learned counsel Mr. Pawar is submitting contrary to the letter of appellant - acquiring body. In view of the same, the concerned offcer i.e. Executive Engineer of the acquiring body is directed to remain present before this court on 12/04/2023.
