ORDER:- 1.

Heard learned Counsel for the applicant. The applicant is seeking transfer of Petition HMP No. 24/2020 filed by respondent husband for getting divorce, from the Court of Civil Judge (Senior Division), Khed, District Ratnagiri to the Family Court, Parbhani.

According to the applicant, she is having no source of income and the distance between Khed and Parbhani is more than 500 kms. She is having one son Ayush of tender age.

Under such circumstances, it is highly difficult for the applicant to attend the dates at Khed. On the contrary, it appears that the respondent, despite service, remained absent. Even otherwise also, the Adhar Card of respondent filed by the applicant indicates that he is resident of Parbhani. Therefore,

(2) 975 MCA-199.2022.odt considering the convenience of the applicant wife, following order is passed.

ORDER

(i) The application is allowed.

(ii) HMP No.24/2020 is hereby transferred from the Court Civil Judge (Senior Division), Khed, District Ratnagiri to the Family Court, Parbhani for disposal according to law.

(iii) The respondent is directed to appear before the learned Family Court, Parbhani on or before 1st February 2023.

(iv) The application is accordingly disposed of.
