The cause of action survives against heirs of Respondent No.1. The averments in the application have not been controverted. 3.

It is also one of the prayers of the Applicants that Appellant No.3A died and her legal heirs are already on record in the form of Applicant Nos.1 and 2. The formal amendment is required to be carried out treating Applicant Nos.1 and 2 as legal heirs. 4.

Civil application is allowed in terms of prayer clauses (b), (c), (d) and (e).
