Mr. Venjane, the learned counsel submits that the petitioner is declared surplus, however, is not absorbed. The petitioner has given representation (Exh. N page 34 to 36), however, the same is not yet considered.

The learned A.G.P. submits that in case the said representation is pending, the authority shall decide the same on its own merits. In the light of that, we pass the following order:-

In case the representation given by the petitioner (Exh. N

wp7434.15 -2page 34 to 36) is pending with respondent No.2, then respondent No.2 shall decide the same on its own merits in accordance with law and policy, expeditiously, preferably within six months.

Writ petition is disposed of. No costs.
