By this civil application, applicant seeks direction to respondent Nos.1 and 2 to pay an amount of Rs.1,30,38,000/- along with interest thereon to the applicant as expeditiously as possible and preferably within two months.

By order dated 08/05/2015 passed in Writ Petition No.8047/2013, respondent No.2 / M.I.D.C. was directed to promote the applicant / petitioner to the post of Chief Engineer with deemed date of promotion with effect from 13/05/2013 and extend all the consequential benefits subject to outcome of departmental enquiry SVH

2 974-CA-3096-25.odt pending against the petitioner. By the review application, applicant seeks review / modification of the said order. 3.

Learned advocate for applicant submits that respondent No.2 M.I.D.C. has now taken a decision to drop the departmental enquiry pending against the applicant vide order dated 17/10/2025 and closed the proceedings.

In view of the order dated 17/10/2025, the Review Application is rendered infructuous and the same is, therefore, disposed of.

So far as the civil application is concerned, since the relief claimed by the applicant is based on the subsequent developments, the same cannot be granted in the civil application filed in disposed of writ petition. As it is a fresh cause of action, applicant should avail appropriate legal remedy for that purpose. Civil application is, therefore, disposed of with liberty to the applicant to file appropriate legal proceedings. 6.

If respondent No.2 / M.I.D.C. acts upon the order dated 17/10/2025 and releases the retiral and consequential benefits to the applicant, then the applicant would not be required to file appropriate legal proceedings.
