Heard the learned counsel for the applicant, the learned APP for the respondents-State and Mr. Y.G. Birajdar h/f. Mr. N.S. Shinde, learned advocate assisting APP.

The applicant is apprehending arrest in connection with Crime No. 416/2024 dated 27.6.2024 registered with Vivekanand Chowk Police Station, Latur, District Latur for the offences punishable under sections 304 and 506 r/w. 34 of I.P.C.

This Court vide order dated 1.8.2024 has granted interim protection to the applicant. Considering the family nature of dispute, this Court by order dated 14.1.2025 has sent the matter to mediation center. However, the mediation failed.

The case against the applicant is that the applicant has not taken care of sister (wife of applicant) of the informant and she was not provided medical facilities and as such the sister of the informant passed away. Today, the learned APP produced medical certificate of the deceased which shows that the cause of death was severe covid acute respiratory distress syndrome with septic shock. Considering the reason of death of the

ABA 1206/24 deceased, the interim protection granted on 1.8.2024 can be confirmed. 5.

In view of the above, the application is allowed and the interim protection granted on 1.8.2024 is confirmed on the following terms : i] The applicant shall attend the police station as and when required.

ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii.

The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 7.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
