Learned Advocate Mr. Bayas for respondent No. 1 in W.P. seeks time to file reply to his application stating that there are averments made in the application which requires reply. 2.

This Court finds that this application is only for restoration of Writ Petition No. 5651 of 2006, even if some averments are made and the material averments are only in respect of dismissal of the order and restoration of the writ

1001ca7484.24 petition of the applicant. Considering this, this Court, inclined to allow the application subject to cost of Rs. 5,000/- to be paid to the respondent as already stated in the order dated 13.02.2020. The cost to be paid within two weeks from today. 3.

It is further made clear that if there is further default on the part of the Writ Petitioner, this Court may dismiss the writ petition and same will not be restored thereafter. With this condition the application stands allowed. The Writ Petition stands restored to its original position with interim relief if any. Looking to the nature of the Writ Petition learned Advocate Mr. Bayas submits that the matter be placed for hearing in the 3rd week of November, 2024. The cost to be paid to Mr. Advocate Mr. Bayas who will hand over the amount to his client i.e. Respondent No. 1, within two weeks from today. The application stands disposed off.
