This application is for withdrawal of amount of Rs.80, 08, 241/- + Rs.25000/- = Rs. 80, 33, 241/- deposited by the Respondent/MSRTC. Its a death claim. The dependents of the deceased have approached this Court, seeking withdrawal of the amount.

Learned Counsel Mr. Bagul appearing for the Respondent has opposed the application. It is pointed out that the salary of the deceased was taken to be Rs. 38,362/- when it should have been about Rs.15,915/-. It is contended that the exorbitant compensation has been awarded by the Tribunal.

Considering rival submissions of the parties as well as impugned judgment and award, I find it fit to permit the Applicants to receive Rs. 30 Lacs on furnishing.

Civil Application is partly allowed, permitting the Applicants to receive Rs.30 Lacs on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court.

The amount shall be disbursed as per apportionment stated in operative part no.3 of the impugned judgment and award. 7.

Balance amount shall be invested in the Nationalized Bank. 8.

Civil Application is disposed of.
