On instruction, the learned counsel for the petitioner seeks leave of this Court to withdraw the writ petition.

The learned counsel for the applicant submits that the evidence is yet to commence in the matter and that he would move appropriate application before the lower court after completion of his evidence. The civil court has dismissed the application for appointment of court commissioner as the plaintiff has not adduced any evidence. Liberty is reserved to the petitioner to move application for appointment of Court Commissioner after completion of evidence. If such application is filed, the Trial Court to decide the same in accordance with law.
