We have heard Mr. Murge, learned counsel for the petitioner.

The punishment has been imposed upon the petitioner by the Chief Executive Officer, Zilla Parishad, Ahmednagar, thereby stopping one increment under the provisions of Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules, 1964.

As per Rule 13 of the Rules, 1964, the petitioner has remedy of Appeal before the Commissioner.

In the light of that, writ petition is disposed of with liberty to the petitioner to avail the remedy of Appeal before the Commissioner. 5.

In that case, all contentions of respective parties are kept open. No costs.
