BENCH AT AURANGABAD CIVIL APPLICATION NO.7585 OF 2019 IN FIRST APPEAL ST. NO. 21055 OF 2018 Shivaji Gangadhar Sakolkar and another Applicants

Versus

The State of Maharashtra & another Respondents Mr. H. B. Nandagavale, advocate for the Applicants Mr. S. N. Kendre, AGP for Respondent No.1.

Mr. S. V. Varad, advocate for Respondent No.2. CORAM : SANDIPKUMAR C. MORE, J.

DATE : 04th January, 2023.

PC :

Heard rival submissions.

The applicants-claimants are seeking condonation of delay of 1824 days which appears to be caused due to their financial crisis.

The learned AGP as well as learned Counsel for the Respondent-acquiring body strongly opposed the application on the ground that there is also circulation delay. However, considering the statutory right of the

{2} ca7585.19.odt applicants, delay of 1824 days stands condoned subject to the condition that the applicants shall not claim any interest for the aforesaid period of delay and also for delay in circulating the matter belatedly.

The appeal be placed for admission after removal of office objections, if any.

Civil Application is disposed of.
