It is informed that the Municipal Council has deposited an amount to the tune of Rs. 48,00,000/-. It is not a matter of controversy that the amount is towards acquisition of the landed property belonging to petitioner and, the petitioner is entitled to claim the aforesaid amount as value of the property. 2.

In this view of the matter, petitioner shall be permitted to withdraw the amount deposited by respondent - Municipal Council in this Court, without any pre-condition.
