Mr. Kale, the learned counsel for the petitioner submits that, the petitioner was not allowed to excavate the sand by the villagers. The respondent Nos. 2 and 3 are required to refund the amount deposited by the petitioner as per the tender agreement dated 25.03.2013.

Mr. Karlekar, the learned A. G. P. submits that, the petitioner at no point of time had made grievance about the return of amount with the appropriate authority. All the representations annexed with the petition are mostly about allowing the petitioner to excavate the sand.

The petitioner may file a comprehensive representation/application to the competent authority with regard to the claim of the petitioner for refund of the amount. Upon receipt of such an application, the competent authority shall take decision on the same on its own merits, in accordance with law and policy expeditiously and preferably within a period of six (6) months from the date of receipt of representation. The writ petition is disposed of. No costs.
