The applicant is seeking bail in Crime No.67 of 2023 registered with Osmannagar Police Station, District Nanded for the offence punishable under Sections 326, 323, 504, 506 r/w 34 of the Indian Penal Code.

The applicant and the injured are neighbours. Earlier the applicant had slapped the injured. Then again the quarrel took place. Now, the allegations have been levelled against the applicant that he assaulted the injured with rod, fist and kicks on his back. 4.

The weapon allegedly used in the crime has been recovered. Nothing remained to be investigated from the applicant. The material investigation against the applicant appears to have been

928-ba-1141-2023.odt (2) completed. However, the apprehension of the prosecution of repeating the crime can be guarded by imposing certain conditions. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Mohan Ramkishan More, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall not threat the injured and his family or other witnesses, till conclusion of the trial. (iv) The applicant shall not enter Village Donwada, Taluka Loha, District Nanded for three months from the date of his release. (S.G. MEHARE, J.) Mujaheed//
