There is delay of 120 days in preferring the First Appeal against the decision in Land Acquisition Reference No.117/2011. 2.
Heard learned Advocates for the parties. The decision is based on compensation granted in another Land Acquisition Reference which is under challenge before this Court. It is submitted that, the compensation of Rs.7000/- per R was fixed as per the Sale Deed, but 65% deduction was made towards development charges. The applicant, due to poverty, could not raise funds for filing the appeal. For the reasons stated, the delay is condoned subject to condition that the applicant shall not be entitled for any statutory benefits for the period of delay.
