I have considered the submissions of the learned Advocate for the petitioner and the respondents. 2.

It is jointly stated that after this Court refused interim relief to the petitioner and the petition was admitted on 12/06/2001, the respondent subsequently was selected as a

905-wp-3168-99 with ca.odt Deputy Commissioner pursuant to an advertisement published. He joined duties as a Deputy Commissioner and has recently opted for voluntary retirement. He had preferred his ULP Complaint before the Industrial Court while he was a clerk and which complaint was allowed by the impugned judgment of the Industrial Court dated 04/03/1999. The learned Advocate for the respondent employee, therefore, submits that nothing would survive in this petition. 3.

Considering the above, this petition is disposed off as being infructuous as the impugned judgment of the Industrial Court having become inoperable.

Rule is discharged.

The pending Civil Application would not survive and stands disposed off.
