Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.400 of 2024 registered with Hingoli City Police Station, District Hingoli for the offence punishable under Sections 307, 326, 324, 452, 323, 506 143, 147, 148, 149 of the Indian Penal Code and Section 4/25 of the Arms Act.

It is case of quarrel between two groups for drainage water. It has been alleged against the applicant that he assaulted the first informant with sword from his back to his head. The persons from both groups have been arrested. The so-called weapons have also been recovered. The medical report of the first informant whom the applicant has allegedly beaten shows simple injury. The applicant is

943-ba-1230-2024.odt (2) languishing in jail since 18.06.2024. It is a quarrel between two families. However, no purpose would be served by keeping the applicant behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Babu Burhan Dargewale, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall not enter Village Garmal till the charge sheet is filed.
