The applicant is seeking bail in Crime No.28 of 2023 registered with Osmannagar Police Station, District Nanded for the offence punishable under Sections 307, 323, 143, 147, 148, 149, 504 of the Indian Penal Code.

Limited role has been attributed to the applicant that he sat on the chest of the brother of the first informant holding chilly powder in his hands. There are no allegations of use of the weapon at the hands of the applicant. There was no evidence that the chilly powder caused harm or injury to the brother of the victim. His antecedents may not come in his way for considering the bail application. Considering the role attributed to the applicant, material

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Pratap Balaji Jadhav, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall not enter Village Chincholi, Taluka Loha, District Nanded for three months from the date of his release. (S.G. MEHARE, J.) Mujaheed//
