Heard the learned counsel for the applicant and learned APP for the respondent/s-State.

The applicant seeks bail in Crime No.1120 of 2023, registered with Newasa Police Station, District Ahmednagar, for the offences punishable under Sections 307, 326, 323, 341, 452, 143, 147, 148, 149, 504, 506 of the IPC. 3.

It is the case of quarrel between the villagers for a land. It has been alleged against the applicant that he assaulted the injured with iron rod and he sustained the injuries to his chest. However, the injury certificate does not correspond the allegations. The material investigation against the applicant has been completed. Charge sheet has been filed. Considering

941-BA.1238-24.odt the nature of the dispute and the age of the applicant, it would be inappropriate to keep the applicant behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant EKNATH MAHADEV GARJE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) He should not tamper with the prosecution witnesses.

(b) He should attend the trial on each and every date.
