BENCH AT AURANGABAD.

WRIT PETITION NO. 667 OF 2013 Mauli Swayam Sevi Sanstha, Morgavhan, Taluka Risod, District Washim.

Petitioner.

Versus

The State of Maharashtra & others Respondents.

*** Mr. R.M. Sharma, Advocate for the petitioner. Mr. P.G. Borade, A.G.P. for the respondents.

*** CORAM : T.V. NALAWADE & SUNIL K. KOTWAL,JJ.

Dated : 09.01.2018.

ORAL ORDER :- 1.

The petition is filed for giving direction to the respondents to consider the proposal given by the petitioner for permission to start new Marathi Medium Secondary School. The proposal was given on 07.06.2012. It is the contention of the petitioner that even Challan was not issued enabling the petitioner to make the payment of requisite charges and the decision is not taken on representation and reply is not filed in the present proceeding by the respondents.

(2) WP No.667/2013 2.

There are copies of the proposal produced on record showing that the proposal was reached to the Authority. The Authority is not expected to create hurdles like even not issuing Challan for making payment by the applicant. The proposal was initially for the year 2013 and we are now in the year 2018. The representations were also made when the proposal was not decided and copies of representations are placed on record. 3.

This Court holds that the Authority needs to do the needful including issuance of Challan for enabling the petitioner to make payment of necessary charges. The Authority is expected to consider the proposal of the petitioner at least for the year 2018-2019. The proposal is to be decided within three months from the date of this order.

4.

This Court has also considered the Government Resolutions issued by Government in the years 2011 and 2012. 5.

With the aforesaid direction, the Petition is disposed of.
