PER COURT :- The petitioner claims to belong to Rajput Bhamta caste which is included in vimukta jati (VJ) category. He has been admitted to Engineering course in respondent No.3 College as against a seat reserved for VJ category. The verification claim in respect of the caste certificate issued to the petitioner is stated to be pending with respondent No.2 committee. As a result of failure of the petitioner to submit validation certificate, respondent No.4 University has not declared the result of the First year Engineering course of the petitioner.
{2} wp 7581.16.odt In the facts and circumstances of the case, this petition can be disposed of with direction to respondent No.4 to declare the result of the petitioner of first year Engineering course. The petitioner shall be permitted to secure admission to second year course, if he is found otherwise eligible. Respondent No.3 shall not deny admission to the petitioner for next year course only on the ground of his failure to submit validation certificate. The admission of the petitioner for next year course, shall be subject to outcome of the enquiry in respect of caste certificate validation proposal pending with respondent No.2 committee. Respondent No.2 is directed to take decision on the caste certificate validation proposal in respect of the petitioner, pending with the committee as expeditiously as possible and preferably within a period of six months from today.
The writ petition is disposed of.
