The learned Advocate Shri. Hon appearing for the petitioners in Writ Petition No.10909/2016, submits that petitioner No.4 - Nitin Gajanan Bhandari and petitioner No.5 - Sunil Mansaram Chaudhari, have informed him in writing that their names be deleted from the proceedings. Copy of the communication is taken on record and marked as 'X-1' for identification.

In view of the above, the names of these two petitioners in Writ Petition No.10909/2016 stand deleted. Deletion be carried out forthwith.

The learned A.G.P. places on record the judgment delivered by the learned Full Bench of this Court in the matter of Deshmukh Dilipkumar Bhagwan and others Vs. State of Maharashtra and others, 2019 (3) Mh.L.J. 903. He submits that the issue raised in these two petitions is squarely answered by the learned Full Bench concluding that pension and retiral benefits would be an entitlement to those retired employees, who were working in an institution which was receiving 100% grant-in-aid on the cut off date.

The learned Advocate Shri. Hon, appearing for the petitioners in Writ Petition No.10909/2016, seeks time to study the judgment.

The learned Advocate Shri. Choudhari, appearing for the petitioner in Writ Petition No.10972/2016, submits that the judgment in Deshmukh Dilipkumar Bhagwan & others (supra) squarely applies to the case of the petitioner. He, therefore, prays for the disposal of the said petition.
