Heard Shri. Adgaonkar, learned counsel for the applicant. Despite service of notice none of the respondents has caused their appearance.

Delay of 29 days is caused in preferring the appeal. The applicant has alleged that time was consumed in contacting Advocate at Aurangabad, for collecting required documents and for arranging the amount for expenses. The delay is not intentional nor deliberate. 3.

Learned counsel Shri. Adgaonkar states that the delay is not intentional. Considering the financial position of the applicant, the applicant was not in a position to arrange the amount required for filing of the appeal and others expenses.

I am satisfied that the applicant has made out sufficient cause for condonation of delay. In view of this, delay is condoned. Appeal be registered if it is fit for registration. Civil application is disposed of. [M. G. SEWLIKAR, J.] ssp ca8958.19.odt
