IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 43 SECOND APPEAL NO. 1739 OF 2005 DALJEETSINGH SARDARSINGH CHHABDA
VERSUS
LAXMAN KHEMCHAND DAHILANI & ANR
CORAM:
VIJAY S.KULKARNI REGISTRAR (JUDL) DATED:
08/03/2017 1.
Perused record and proceeding. The objection notified by the office is that court service notice issued to appellant sole returned unserved on the ground that he is not residing on the given address. The bailiff report filed on record dated 06/06/2012 clearly indicates that appellant Daljeetsingh Sardarsingh Chhabda is not residing on the address given in appeal memo. Thereafter, no steps have been taken by the appellant to furnish correct address of the appellant. About four chances have been given to the appellant for removing the objection. None is present on behalf of the appellant. There is no leave note filed by the learned Advocate for the appellant for today's date. In view of the above, I pass following order.
ORDER
The appeal stands dismissed for failure to prosecute. REGISTRAR (JUDL) sa1739.05(43)
