Heard the respective learned counsels for the applicants and learned APP for the respondent/s-State.

Leave granted to delete applicant Nos.1 and 3 in Bail Application No.1242 of 2024. Necessary amendment be carried out forthwith.

The applicants seek bail in Crime No.256 of 2024, registered with Paithan Police Station, District Aurangabad, for

the offences punishable under Sections 394, 397 read with Section 34 of the IPC.

It has been alleged against the applicants that they went to the house of the first informant and asked him to pay money to drink liquor. When he denied, one of the co-accused assaulted him with beer bottle on his head and extracted Rs.2,000/-. The allegations against the applicants were that they caught hold of the injured. However, nothing is recovered from them. Against these applicants, one case under Maharashtra Gambling Act is pending. Considering the role attributed to the applicants and the nature of the offence, this Court is of the view that their further detention would serve no purpose. However, certain conditions may be imposed. Hence, the following order :

O R D E R

(i) Bail Applications are allowed.

(ii) Applicant RUSHIKESH RAJU JAMDHADE in Bail Application No. 1219 of 2024 and Applicant MUKESH JAGANNATH SALVE in Bail Application No. 1242 of 2024 be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of like amount each, on the following conditions :

(a) They shall not tamper with the prosecution witnesses.

(b) They shall attend the Police Station on every Monday between 10.00 a.m. to 1.00 p.m. till the charge sheet filed.

(c) Thereafter, they shall attend the trial on each and every date.
