Petitioner's proposal for renewal of licence under the Juvenile Justice (Care and Protection of Children) Act, 2015 ('Act') has been pending with the respondents.

Learned AGP points out that inspection of the petitioner's establishment was carried out, certain deficiencies were noted and the report was submitted by the District Women and Child Development Officer dated 11-02-2020 to respondent no. 2 - Commissioner, Women and Child Development, Pune.

Irrespective of the fact whether the petitioner has been able to overcome the shortcomings mentioned in these proposals / report, the decision rests with the respondent no. 2 to decide petitioner's proposal on its own merits. Incidentally, learned AGP adverts our attention to circular dated 13-11-2018 constituting committee for taking decision under section 41 of the Act. 5.

We dispose of the writ petition by directing the respondents to process the petitioner's proposal and decide it in accordance with law, if it has not already been decided, as expeditiously as possible and in any case within eight (8) weeks. 6.

The respondents or the committee constituted under the government resolution dated 13-11-2018, before taking any decision, shall call upon the petitioner to remove the deficiencies and / or hear it as regards the manner in which the deficiencies have been cured.
