This is the Application filed under Section 482 of the Code of Criminal Procedure for quashing R.C.C. No. 141/2021 pending before the learned Judicial Magistrate First Class, Shahada, Dist. Nandurbar, for the offences punishable under Sections 498A, 323, 504, 506 r/w 34 of the Indian Penal Code.

It is submitted by learned advocate Ms Sabahat T. Kazi for the Applicants that the matter has been amicably settled between the parties. She submits that the informant/respondent no. 2 has joined the company of husband. She has placed on record the affidavit of respondent no.2/informant, wherein she has stated that since 2022, the

2 903APPLN2851.2024.odt respondent no.2/informant has been residing with Applicant No. 1 at Pune and the crime in question was registered out of misunderstanding and now she wants to reside with the Applicants without any hesitation and states that the RCC be quashed and set aside. 3.

Learned advocate Mr. V. H. Sangole appears for respondent no. 2. Learned APP for the State opposes the Application. 4.

Admittedly, the dispute between the parties arose out of the matrimonial relations. The parties have put an end to the dispute between them. In this view of the matter, we exercise powers under Section 482 of the Code of Criminal Procedure and pass the following order.

ORDER

Criminal Application is allowed in terms of prayer clause ' B'

thereof and disposed of.
