On the last occasion after hearing learned Counsel for the Petitioner this Court has shown disinclination to cause interference in the impugned. Today, learned Counsel for the Petitioner, on instructions, seeks withdrawal of the Petition. He however seeks clarification that the dismissal of the Petition shall not come in way of the Petitioner to raise objections during the course of trial, as available in law.

Petition is dismissed as withdrawn with liberty as prayed.
