Mr Dhongade, the learned counsel for the respondents submits that, he has received written communication dtd.05.10.2019 from the respondent to the effect that, the order terminating the services of Mr Rode would be withdrawn and the decision shall be taken that he died while in service. The communication is taken on record and marked 'X' for identification. The communication further states about the payment of salary till the death of Mr Rode and about considering the application of his legal heirs for compassionate appointment.
