Learned counsel for the applicants submits that the original claimant Govind Kale died during pendency of first appeal. Legal heirs were not knowing about pendency of appeal and as such, delay has occurred. Learned A.G.P. appearing for the respondent has no objection, if the application is allowed.

In view of above and for the reasons stated in civil application, civil application is allowed in terms of prayer clauses "B" and "C' and disposed of.
