Shri. P. B. Rakhunde, learned counsel for the applicant submits that his client has received inadequate compensation on account of acquisition of his house property. He further submits that although the Acquiring Body is challenging the findings of the Trial Court in respect of wrong calculation and formula, the Acquiring Body has deposited only 75 percent of the award amount. 2.

For the reasons stated in the application, the Civil Application is partly allowed.

The applicant is permitted to withdraw 50 percent of the deposited amount by furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court. The applicant is also permitted to withdraw further 25 percent of the deposited amount by furnishing solvent securities/sureties to the satisfaction of the learned Registrar (Judicial) of this Court.

The Civil Application stands disposed of.
