Heard learned counsel for the petitioner.

The petitioner has preferred this criminal writ petition against the order of the learned Additional Sessions Judge, Aurangabad dated 01.04.2023 in Sessions Case No.53/2023. 3.
By the application, the petitioner had sought releasing the mobile handset which was a part of the investigation and perhaps to be used as an evidence.

The learned Additional Sessions Judge has correctly observed that it being a part of the investigation and a piece of evidence, it may be required for identification. The reasons for rejecting the application for supratnama are legal, proper and correct. There is no substance in the petition. Hence, the petition stands dismissed in limine.
