Heard learned Advocate appearing for applicants and respondent No.3 V.G. Mete - party-in-person.

Considering submissions advanced and nature of litigation, it would be appropriate to permit applicants to bring on record legal heirs of respondent No.2, who died on 30.04.2021. However, as rightly pointed out by learned party-in-person, the delay is not adequately explained, hence, the contesting respondent needs to be compensated with costs. Consequently, application is allowed in terms of prayer clause

945_CA_8345_2023 "B" and "C", subject to condition that applicants shall pay costs of Rs.3,000/- (Rupees Three Thousand only) to contesting respondent No.3 i.e. Mr. V.G. Mete - party-in-person, on or before 16.08.2024. Amendment to be carried out on or before 16.08.2024. Application stands disposed of.
