1] Heard Mr. Amit Sawale, Advocate (appointed).
2] With the assistance of the learned counsel, we have gone through the contents of the application annexures thereto, so also, the contents of the affidavit filed by Mr. Jaysingh Lakadya Pawara, working as Deputy Secretary, Home Department, Upon perusal of the pleadings, we are of the opinion that the petitioner has been placed in Category-2(c) of the guidelines laid down in the Government Resolution No. RLP1006/C.R.621/PRS-3, dated 15th March, 2010 subject to actual imprisonment of 14 years. The petitioner's case was then decided by; the State vide order dated 16.9.2016.
3] There is also assurance in the affidavit that as and when the petitioner will complete 26 years imprisonment with remission, including the period of set off, he will be released from jail. 4] In view of the reply filed by the respondents, nothing remains for adjudication in the instant matter. 5] Since Mr. Amit Sawale, Advocate is appointed as Amicus Curiae to prosecute the case of the petitioner, his fees be paid as per the Schedule of Fees maintained by the High Court Legal Services Sub Committee, Aurangabad.
