IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.11104 OF 2017 MOHAMMAD MASTAN MOHAMMAD KASIM

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS Mr. K.M. Nagarkar, Advocate for petitioner.

Mr. P.N. Kutti, AGP for respondent/State.

Mr. Ajinkya Deshmukh h/f. Mr. A.V. Hon, Advocate for respondent No.3. Mr. Ajinkya Reddy, Advocate for respondent No.4. CORAM :

SUNIL P.DESHMUKH & S.M.GAVHANE,JJ.

DATED :

27.08.2019 P.C. :- 1.

After hearing learned counsel, it appears that petitioner requests for legitimate pensionary benefits based on his service, giving it proper treatment having regard to decisions taken by government from time to time. While representation dated 16-09-2016 had been deemed by concerned authority to be a request to have benefit of time bound promotion, it does not appear that representation restricted only to that request. In the circumstances, situation can be met with, if petitioner makes proper representation with concerned authority to be decided on its own merits. If representation is submitted by petitioner within a period of one month from today, same be decided within a period of two months thereafter. 2.

Writ petition is disposed of accordingly.
