PER COURT :

The petitioner joined employment on 16.9.2019 as a Shikshan Sevak. She tendered her tribe claim (Thakur scheduled tribe) for validation. The tribe certificate was not in format 'C' and hence, it had to be rectified. Subsequently, on account of territorial jurisdiction, the tribe certificate was cancelled. This obstacle was overcome by the petitioner and finally she submitted a fresh proposal on 23rd December 2019. As she was not able to secure a validity certificate from the Committee, the employer - Brihanmumbai Mahanagar Palika, Education Department terminated her services vide communication dated 22.7.2022. 2.

The learned AGP representing the Committee submits, on instructions, that the petitioner can appear before the Committee on 5th September 2022, at Dhule at 12.00 noon. The Vigilance Cell

WP No.8269/22 report is already supplied to her and she has also tendered her written say. A hearing would be conducted on 5th September, 2022 and a final order would be delivered by 7th October, 2022. 3.

The learned counsel for the petitioner submits that she will remain present on the given date, time and place and not seek an adjournment.

In view of the above, this petition is disposed off, by recording the statements as above.

The Committee shall deliver a final order, on or before 7th October, 2022.

Needless to state that if the petitioner succeeds in acquiring the validity certificate, she would produce the same before her employer with a request letter for reinstatement and we expect the employer to consider the same, in accordance with the rules.
