The applicant has filed this application seeking his release on anticipatory bail in connection with crime No. 125 of 2025 registered with Parli City Police Station, Dist. Beed, for the offences under Sections 307, 377, 498-A, 323, 504, 506 r/w. 34 of IPC. 2.

The allegations in the FIR lodged by complainant - Amruta Ippar are that, the applicant, being complainant's husband, alongwith his relatives subjected her to persistent physical, mental and financial cruelty over a span of several years. The complainant further alleged commission of unnatural sexual acts by the applicant which are punishable under Section 377 of the IPC, physical assault during menstruation and an attempt to choke and kill her (Section 307 of IPC. 3.

The learned counsel for the applicant submits that the allegations are vague and there is no specific incident narrated by the complainant and as such, custodial interrogation of the applicant is not

It is the submission of learned counsel for the applicant, that other 4 accused i.e. parents of the applicant and brother and sister of the applicant and her husband, have already been granted anticipatory bail by the learned Sessions Judge, Ambejogai, vide order dated 22.7.2025. It is the submission that merely on the basis of the allegations made 17 years after the marriage, the applicant is being harassed by the police people only on the ground that there are allegations of attempt to commit murder without there being any evidence to that effect. 4.

He, therefore, submits that he is ready to cooperate with the investigation and is permanent resident of Pune and would attend the trial as and when necessary.

As against this, the learned APP, appearing for the State has opposed the application on the ground that there are serious allegations of unnatural sex against the present applicant over his wife-complainant and further allegation pertains to attempt to commit murder, which is punishable with life imprisonment. As such, looking to the gravity of the allegations, the application may not be entertained by this Court, as the investigation is yet to be completed. There is likelihood that the applicant may threaten the prosecution witnesses including the complainant and her minor children, who are now residing with complainant/wife.

I have gone through the investigation papers and the allegations in the FIR alongwith order dated 22.7.2025 passed on the application filed by Ramchandra, Rahul and Shantabai Ippar. After going through the same, it is found that the marriage of the applicant with complainant was performed in 2008 and out of the matrimonial discord. Except for the bald allegations of attempt to commit murder of the complainant wife by applicant husband, the evidence collected by the

{3} I.O. during the course of investigation does not substantiate the allegations. I am, therefore, inclined to protect the applicant by exercising discretion under Section 438 of Cr.P.C. Hence, the following order :-

O R D E R

[I] In the event of arrest of the present applicant in connection with Crime No.125 of 2025 registered with Parli City Police Station, Dist. Beed, for the offences under Sections 307, 377, 498-A, 323, 504, 506 r/w. 34 of IPC. the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rs. 50,000/- with one or more sureties in the like amount.

[ii] The applicant shall attend the Investigating Officer of as and when called and cooperate with the investigation, till the completion of investigation and filing of charge sheet.

[iii] The applicant shall not tamper with the prosecution evidence; and shall not influence the witnesses. [iv] The applicants shall submit his Aadhar and Pan Card to the Investigation Officer and detailed addresses and phone numbers of applicant and of two of the near relatives.

[v] The applicant shall attend the trial regularly except in emergency, he can seek exemption from the trial court. [v] The application is disposed of.
